To: State of Colorado Date: 5-5-2008 <br /> Division of Natural Resources <br /> Division of Reclamation Mining and Safety RECEIVED <br /> MAY 16 2008 <br /> Tony Waldron <br /> Division of Reclamation, <br /> Senior Environmental Protection Specialist Mining and Safety <br /> David Bird <br /> Senior Geochemist <br /> We (TX1 Operations LP., Boulder Mine#M-1948-108)would like to request <br /> that we move our mining boundary and release that acreage that is 30 feet wide and <br /> 1106 feet in length that has never been mined_ When released,this piece of land <br /> will become a walking trail easement to be used and maintained by the City of <br /> Boulder Open Space to provide a walking and hiking trail along HWY 93 in <br /> Jefferson County Colorado. This is in conjunction with a granted easement by the <br /> Hogan's Ranch and its family. The legal description of the said land that we would <br /> like to release from our mining boundary is on(Exhibit MAP 1)which is attached <br /> along with this letter. We have also attached a map (A-1)showing the mining <br /> boundaries for Mine # M-1998-108). <br /> To our knowledge and since (TM Operations LP_) have leased this mining site <br /> we have not mined on the land that we would like to release. The mine site is <br /> owned by the Hogan family's and has been in there possession for over 100 years. <br /> We do not feel that this warrants changing the security reclamation bond that goes <br /> along with rest of the leased mine due to it being a small portion of land that we <br /> would like released. <br /> All the parties affected have been sent a copy of this document Their names, <br /> addresses, and phone numbers are listed below: <br /> Bill Hogan Living Trust <br /> William J.
