ARCOSA <br /> approximate hydraulic conductivity of 1x10`cm/s or less, as discussed in Exhibit D and E. The <br /> SEO has evaluated the condition of the quarry and determined that the source of water is natural <br /> runoff tributary to Coal Creek. Considering the nature of the quarry materials, the proposed <br /> reclamation conditions shown on Exhibits F-1 and F-2, the source of water to the quarry area, <br /> and the location of groundwater,the likelihood of groundwater exposure in the post-reclamation <br /> condition is negligible. It is possible that groundwater occurring as infiltrated stormwater within <br /> the alluvial materials, present between 0 ft and approximately 20 feet below ground surface <br /> (bgs), may drain into the proposed reclamation pond (Hogan Pond), as indicated by the SEO; <br /> however, this water is intermittent. <br /> DRMS Reference (underline) and Comment(italics) <br /> EXHIBIT M - Other Permits and Licenses (Rule 6.4.13): A statement identifyiniz which of <br /> the following permits, licenses and approvals the Operator/Applicant holds or will be seeking in <br /> order to conduct the proposed mining and reclamation operations: effluent discharge permits, <br /> air quality emissions permits, radioactive source material licenses, the State Historic <br /> Preservation Office clearance, disposal of dredge and fill material (404) permits, permit to <br /> construct a dam, well permits, highway access permits, U.S. Forest Service permits, Bureau of <br /> Land Management_ permits, county zoning and land use permits, and city zoning and land use <br /> permits. <br /> No permitting is required through Jefferson County for this site%peration? <br /> Arcosa's Response: <br /> The Lightweight Aggregate facility operates under an Official Development Plan (ODP) <br /> through Jefferson County. An updated table of permits and licenses is provided in Exhibit M, <br /> which is included in Attachment 9. <br /> Arcosa has been in communication with Jefferson County to inquire whether the ODP will <br /> require modification as a result of this Amendment 3. At this point Jefferson County is still <br /> evaluating the need for a minor modification to the development plan. If such a modification is <br /> required, Arcosa will work with Jefferson County to modify the ODP after DRMS approves the <br /> amendment.. <br /> DRMS Reference (underline) and Comment(italics) <br /> EXHIBIT N - Source of Legal Right to Enter (Rule 6.4.14): You must provide the source of <br /> your right to enter and initiate a mining operation on the affected land. <br /> Permittee will need to demonstrate that Arcosa is the legal landowner for the "processing <br /> facility"area.
