COLORADO
• a Division of Reclamation,
Mining and Safety
Department of Natural Resources
September 10, 2019
John Kuijvenhoven
6124 County Road 5
Ridgeway, CO 81432
RE. Horsefly Rock Source, File No.M-2019-010, Construction Materials Limited
Impact(110) Application Adequacy Review
Dear Mr. Kuijvenhoven:
The Division of Reclamation,Mining and Safety(Division) is in the process of reviewing the
above referenced application in order to ensure that it adequately satisfies the
requirements of the Colorado Land Reclamation Act for the Extraction of Construction
Materials (Act) and the associated Mineral Rules and Regulations of the Colorado Mined
Land Reclamation Board for the Extraction of Construction Materials (Rules). During
review of the material submitted, the Division determined that the following issue(s) of
concern shall be adequately addressed before a decision can be rendered.
1. Exhibit C-Mining Plan:
avIn the narrative of the mining plan, several features such as an office building,
scale and scale house and various processing equipment are discussed.
Pursuant to Rule 6.3.3 (e) please provide details of the location of these
features. Please also provide details of the location of the fuel storage units
with their proper secondary containment.
In the Mining Plan it is stated that the minable sandstone later varies in
depth from 6-12'which is interpreted to be the worst case scenario height of
the mining face. Details on the anticipated length of the mining face however
is not included. Please commit to a maximum length of exposed mining face
at any given time.
1,2✓ Exhibit D-Reclamation Plan: 1n the Reclamation Costs section of the Reclamation
Plan, there is a subsection titled "Area needing soil preparation, reseeding,
mulching". In this section the area needing revegetation is listed as 25 acres. This
appears to be a typographical error that needs clarifying. Please clarify the number
of acres that will require topsoil replacement, soil preparation, seeding and
mulching.
I
1313 Sherman Street, Room 215,Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us * *%
Jared S.
