The Yeldell Inspection Report states that"Any retained water within <br /> the pits must be pumped out within 72 hours". This appears to be based upon Ms. Yeldell's conclusion that the irrigation <br /> and collection of water is part of the mining operation. The C&D says that Rudy is prohibited from entering the site(permit <br /> area) to conduct any mining operations. While we disagree that the irrigation is a mining operation,we wish to cooperate <br /> with you. If we do the pumping, will Mr. Means conclude we have violated the C&D? <br /> We will use a pump and hose to draw water from the west pond(east pond is dry, at last view on 7.12), then run the water <br /> down a barrow ditch on the west side of the road, releasing water into the natural defile shown on the attached aerial <br /> photo made June 27th. The water then enters the drainage channel built by Powderhorn Coal located in the North <br /> Decline area. <br /> Is this plan acceptable to you?
