This decision will become final at the close of the thirty (30) day public comment period, which commences with the initial publication in the The Daily Sentinel. A copy of the proposed decision and written findings is enclosed. This partial Phase II and partial Phase III bond release approves the release of 10.4 acres (2.4 acres of Phase II and Phase III, and 8.0 acres of Phase III) and 291.3 acres of affected lands within the Roadside Mine Permit. 0.3 acres of land is located to the west of I-70 and the remaining 301.4 acres are located on the east side of I-70. The 301.7 acres of land have met the standards for the post mining land use of wildelife habitat. Since this mine is a federal mine, our decision is subject to the concurrence of OSM, and the signature of an authorized OSM representative is required for release of the bond. Therefore, the Division respectfully requests that OSM notify the Division of concurrence or nonconcurrence prior to the end of the public comment period, in accordance with the agreement dated June 30, 1997, Procedures for Cooperating State and Federal Agencies to Provide Mutual Concurrence on the Release of Performance Bonds from Federal Lands Coal Mining Operations.
