This decision will be published in the The Daily Sentinel, as soon as possible. Publication of the notice initiates a thirty (30) day public comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the decision will become final. This partial Phase II and partial Phase III bond release approves the release of 10.4 acres (2.4 acres of Phase II and Phase III, and 8.0 acres of Phase III) and 291.3 acres of affected lands within the Roadside Mine Permit. 0.3 acres of land is located to the west of I-70 and the remaining 301.4 acres are located on the east side of I-70. The 301.7 acres of land have met the standards for the post mining land use of wildelife habitat. As an interested party, you have the right to an adjudicatory hearing as outlined under Rule 3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written and state with specificity the reasons why the hearing is requested. The request must be received within thirty days of the first publication of the proposed decision in the The Daily Sentinel.
