This decision will be published in the The <br />Daily Sentinel, as soon as possible. Publication of the notice initiates a thirty (30) day public <br />comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the <br />decision will become final. <br /> <br />This partial Phase II and partial Phase III bond release approves the release of 10.4 acres (2.4 <br />acres of Phase II and Phase III, and 8.0 acres of Phase III) and 291.3 acres of affected lands <br />within the Roadside Mine Permit. 0.3 acres of land is located to the west of I-70 and the <br />remaining 301.4 acres are located on the east side of I-70. The 301.7 acres of land have met the <br />standards for the post mining land use of wildelife habitat. As an interested party, you have the <br />right to an adjudicatory hearing as outlined under Rule 3.03.2(6) of the Rules and Regulations. <br />The request for an adjudicatory hearing must be written and state with specificity the reasons <br />why the hearing is requested. The request must be received within thirty days of the first <br />publication of the proposed decision in the The Daily Sentinel. <br />
