Exhibit S: Permanent Man-made Structures <br /> Pursuant to Section 6.4.19 of the Colorado Mined Land Reclamation Act(the Act), included below are <br /> details of all permanent man-made structures within 200 feet of the affected lands and within the <br /> permit boundary. <br /> Black Mountain Sand Weld LLC's (Black Mountain) Lost Creek Mine affected lands area, as defined by <br /> 1.1(3) of the Act, have been designed to be set back from the permit boundary by at least 200 feet, <br /> ensuring a buffer area between the active project and neighboring lands. Structures inside the affected <br /> lands boundary include: <br /> • Portions of Morgan County Quality Water District's water line,which runs east west along the <br /> dividing line of Sections 11 and 14; <br /> • A Morgan County underground power line, which runs east west along the dividing line of <br /> Sections 11 and 14,and is believed to no longer be in use; <br /> • Wiggins Telephone underground line, which runs southwest-northeast across Section 11, and is <br /> believed to no longer be in use; and <br /> • An access easement for two nearby communication towers,which runs in the same corridor as <br /> the water and telephone lines listed above. <br /> A minimum 200-foot buffer has been added around these structures,as shown on Exhibit C6.1—Exhibit <br /> C6.2: Mine Plan Map. Black Mountain has designated a 50' Utilities Easement Corridor adjacent to the <br /> west and south edges of their property in Section 14,as shown on Exhibit C6.1—C6.2. Black Mountain is <br /> actively working to obtain relocation and/or removal agreements with the owners of all the above- <br /> mentioned structures to remove them or relocate them to the utilities easement corridor, as <br /> appropriate. Proof of these agreements will be provided as they are finalized. If agreements cannot be <br /> reached,the 200-foot buffer will remain in place and the structures will be mined around, as discussed <br /> in Exhibit D. <br /> Known Structures outside the affected lands boundary but inside Black Mountain's permit boundary <br /> (the buffer area) include an additional portion of Morgan County Quality Water District's water pipeline, <br /> which traverses the S%of Section 10,two communication towers located in NW%of Section 14, an <br /> electrical box owned by Kinder Morgan, and an overhead powerline running adjacent to 1-76 in Section <br /> 14. A portion of the Morgan County Quality Water District's waterline and the entire overhead <br /> powerline are located at least 200 feet from the affected lands boundary. Black Mountain Land <br /> Company, LP has a pending permanent easement agreement with American Tower Asset Sub, LLC for a <br /> small portion of land within the NW%of Section 14,which would include one of the communication <br /> towers and the access road, as shown on Exhibit C6.1—Exhibit C6.2: Mine Plan Map. Black Mountain is <br /> in the process of getting a structure agreement with the owner of the second communication tower, <br /> Pinnacle Tower(owned by Crown Castle). Black Mountain is also working towards a structure agreement <br /> for the Kinder Morgan electrical box, however we believe such structure is inactive based on <br /> conversations with Kinder Morgan.These areas are currently within the permit boundary but located <br /> outside of the Lost Creek Mine affected lands area and will not be disturbed by proposed mining <br /> activities.The American Tower easement agreement is expected to be executed shortly. Easement <br /> agreements and/or structure agreements will be provided as they are available. <br /> 1 <br />
