This package <br /> included all documentation provided to the division since June 26,2019. <br /> Item 27—Permanent Man-made Structures <br /> Exhibit S has been revised to include details on the utilities and other structures within the proposed permit <br /> boundary. Black Mountain is actively working to obtain easements,change easements,obtain relocation <br /> agreements,etc.with many of these structure and utility owners.To be conservative,a 200-foot buffer has <br /> been included around the Morgan County Quality Water District's water line, Morgan County underground <br /> power line, and the Wiggins Telephone line, all of which are located within the affected lands boundary and <br /> shown on confidential Exhibit C6.1—Exhibit C6.2. Black Mountain is actively working to obtain relocation or <br /> removal agreements with the owners of those structures and will provide a copy of those agreements when <br /> finalized. <br /> Additional structures and utilities exist within the minimum 200-foot offset buffer surrounding the affected <br /> lands boundary. Black Mountain is actively working with American Tower and Pinnacle Towers(Operated by <br /> Crown Castle)the current owner of the easement for the communication leases to obtain a notarized no <br /> negative effect letter. Proof of all agreements or letters will be provided to the division as they are finalized. <br /> Other easements exist within the buffer area that are more than 200 feet from the affected lands boundary, <br /> such as the overhead line running adjacent to the southern property boundary in Section 14, and so do not <br /> require structure agreements.The buffer distances of these structures and utilities are shown on Exhibit C2: <br /> Pre-Mining Map. Black Mountain will continue to identify other potential utilities and easement holders at <br /> the site; a surveying company has been contracted to complete an 811 search of the property within the <br /> coming weeks. If additional utilities or other easement holders are identified by this search, Black Mountain <br /> will attempt to obtain a notarized structure agreement or notarized letter per Section 6.4.19 of the Rules <br /> and provide a copy to the division.
