CULPEPPER, in her official <br /> capacity as Treasurer of Adams County, Colorado <br /> STIPULATED RULE AND ORDER <br /> THIS MATTER has come before the Court on the Petition in Condemnation of <br /> Petitioner, the City of Thornton, for the taking of certain real property and real property interests <br /> hereinafter described, and for the ascertainment of the compensation to be paid therefore. <br /> THE COURT HEREBY FINDS: <br /> 1. That this Court has full and complete jurisdiction of the subject matter of this <br /> action and the parties thereto; that service of process has been made upon all interested parties <br /> as required by law or that the same have subjected themselves to the jurisdiction of the Court; <br /> and, that respondent Equity Funding LLC ("Equity") is the owner of the property being <br /> condemned herein as described in Exhibit A hereto ("Subject Property"). <br /> 2. Petitioner and Equity have reached an agreement as to total compensation to be <br /> paid for the Subject Property in the amount of $200,000.00. Petitioner and Equity have also <br /> agreed that Petitioner shall additionally reimburse Equity for its appraisal in this case in the <br /> amount of $9,500.00. Therefore, total compensation for the taking of the Subject Property, <br /> including all costs, attorney fees, expenses and interest, shall be$209,500.00. <br /> 3. Lisa Culpepper, as Treasurer of Adams County, Colorado, filed an Answer to the <br /> Petition in Condemnation with this Court. The Treasurer made a claim for prorated real <br /> property taxes for 2019 for the Subject Property. Real property taxes for 2019 shall be prorated <br />
