Page 4 of 73 <br /> Summary <br /> Permit C-2010-088 <br /> CAM submitted an application for a new permit on September 22, 2010. The Division issued <br /> permit C-2010-08 8 for the Fruita Loadout on March 6, 2012. The permit was approved as a coal <br /> loadout only and no underground or surface mining will occur within the permit boundary. The <br /> Fruita Loadout will be operated by CAM and is located on privately owned lands within Mesa <br /> County, Colorado. The legal description of the lands included within the permit area is: <br /> Township 1 North, Range 3 West, Ute P.M. <br /> Section 2: Portions of the SW/4, W/2SW/4SE/4 <br /> Section 3: Portions of the SEA SE/4SE/4NE/4 <br /> Section 10: Portions of the N/2NE/4 <br /> Section 11: Portions of the N/2NW/4,N/2NE/4, SE/4NE/4 <br /> The Fruita Loadout permit boundary contains 208.6 acres of land that are all located on private <br /> surface. CAM owns 201.3 acres, the Union Pacific Railroad owns 5.3 acres, and Fruita <br /> Development, LLC owns 2.0 acres. The minerals within the proposed permit area are owned by <br /> the respective private surface owners. CAM is approved to disturb 38.1 acres within the permit <br /> area. <br /> Histor <br /> The Fruita Loadout permit was issued by the Division on March 6, 2012 and was immediately <br /> placed in Temporary Cessation. On October 26, 2012 the Division issued final approval for <br /> Technical Revision No.1 which allowed for the suspension of all water monitoring at the loadout <br /> site. Through adverse possession, CAM lost a total of 7 acres of permit area to an adjacent <br /> landowner. With the final approval of Technical Revision No.2 on March 18, 2014, the permit <br /> boundary was adjusted to its current acreage of 208.6 acres. As of the date of this midterm <br /> review, no mining related activity or disturbance has occurred at the Fruita Loadout. <br /> Description of the Environment <br /> The Fruita Loadout is located approximately 3 miles northwest of the city of Fruita and 1.3 miles <br /> southeast of the town of Loma, Colorado. The permit area is located north of the Colorado River <br /> and is situated between State Highway 6 and State Highway 50 and Interstate 70. The permit <br /> area is found on USGS Mack, Colorado 7.5 minute topographic map <br /> The permit area and adjacent area lie within western Mesa County. Private lands are under the <br /> jurisdictions of Mesa County and the city of Fruita. Existing land uses within the permit and <br /> adjacent area consist of industrial, agricultural, rangeland, fish and wildlife habitat and a <br /> transportation corridor. <br /> There is sparse noxious and invasive vegetation and native shrubs covering parts of the site, <br /> along with Tamarisk trees, native grasses and shrubs lining the surface waterways. These <br /> surface water bodies include Reed Wash and the Loma Drain, both traversing the site in a <br /> general northeast-southwest direction and flowing toward the nearby Colorado River. <br />
