Page 8 of 73 <br /> A cluster of five monitoring wells and three industrial wells are located on the east side of the <br /> industrial area, north and south of Haul Road# 1. Due to the distance from the proposed loadout <br /> operations, these wells are not anticipated to be affected by the Fruita Loadout. Further to the <br /> south of this well cluster are five additional water rights associated with pumps, a pond, a canal <br /> and one pumping pipeline owned by the operator. <br /> There are eight water rights that are located across the state highway and railroad to the northeast <br /> of the permit area. These water right sites are listed as diversion points, a spring, one pump and <br /> pipeline, and one irrigation ditch. All of these sites are at least 3,000 feet upgradient of the <br /> planned disturbance, as such, no negative effects from loadout operations are expected. <br /> Four water rights involving two irrigation wells and a ditch with an associated pump are located <br /> at least 6,000 feet downstream of the proposed loadout, alongside the Colorado River. Also, <br /> three water rights associated with two ponds and one monitoring well are located approximately <br /> a mile from the east end of the proposed Haul Road#1. Due to the distance from the approved <br /> permit boundary and the dilution effect of the Colorado River, negative effects are not expected. <br /> Should there be injured water rights due to the operations at the proposed loadout, CAM has a <br /> water replacement plan in place. Details of the alternate sources of water can be found in <br /> Section 2.04.7(3) of the PAP. <br /> Revisions to the Permit <br /> The following is a summary of the revisions to the permit since the issuance of Permit Renewal <br /> No.l for the Fruita Loadout permit dated January 15, 2019. <br /> Minor Revisions: <br /> Minor Revision No. 7 (MR-7) was submitted on January 4, 2019. The revision was approved <br /> and issued on February 14, 2019. MR-7 updated section 2.03, Identification of Interests, of the <br /> C-2010-088 Permit. <br /> Minor Revision No. 8 (MR-8) was submitted on March 28, 2019. The revision was approved <br /> and issued on April 3, 2019. MR-8 incorporated the start and end dates for the three-year <br /> commencement periods within which surface coal mining and reclamations operations must <br /> commence. Also the revision application included a revised page to edit the change of the <br /> Resident Agent from Joe Brinton to Ron Hull. <br /> Status of Stipulations <br /> The following Stipulation remains in effect: <br /> Stipulation No. 1 <br /> PRIOR TO INITIATING ANY DISTURBANCE AT THE FRUITA LOADOUT, CAM- <br /> COLORADO, LLC MUST OBTAIN THE FOLLOWING PERMITS AND SUBMIT THEM TO <br /> THE DIVISION FOR INCORPORATION INTO THE PERMIT APPLICATION PACKAGE: <br />
