Page 9 <br /> Ellicott Sand& Gravel LLC -M-2017-063 <br /> Adequacy response 01 <br /> No, I mailed a request for information to them on July 26, 2018 and then made phone <br /> contact with the Southeast Regions, Colorado Springs office on August 16, 2018 and was <br /> told by Karen Voltuer (sic) that they only provided that service to the state or county <br /> when asked. No formal written correspondence was sent to confirm this. I have attached <br /> a copy of the Information Request packet I mailed to CPW for the file. <br /> 6.4.10 EXHIBIT J—Vegetation Information <br /> 19. Haul/Access Roads: The second paragraph discusses road crossings through the <br /> ephemeral drainages. Please see Comment No. 3 above with respect to road crossing <br /> designs. <br /> The existing ephemeral drainage road crossing are controlled by Schubert Ranch and will <br /> not be used by the mining operation for Stage I thru IV and VI and will remain when the <br /> area is reclaimed. <br /> 6.4.12 EXHIBIT L—Reclamation Costs <br /> 20. Reclamation costs: The DRMS will estimate a bond based on your responses to the <br /> adequacy comments herein after they are received. <br /> Thank you we will look forward to seeing your estimate. <br /> 6.4.14 EXHIBIT S—Permanent Man-made Structures <br /> 21. Structure Agreements: Exhibit S appears to demonstrate all necessary structure damage <br /> compensation agreements were mailed. No signed or returned damage compensation <br /> agreements have been received to date. If all damage compensation agreements are not <br /> signed, returned and copies provided to the DRMS, engineering evaluations pursuant to <br /> Rule 6.4.19, will be required to demonstrate these structures shall not be damaged by the <br /> proposed mining activities. <br /> We have received one agreement, from Schubert Ranch, of the seven structure <br /> agreements that were mailed on 11/30/18. As of July 8, 2019, no other have been <br /> returned. A copy of the returned agreement is attached for the file. Should any more be <br /> received, copies will be submitted to the Division for the file. <br /> 22. Wells: Exhibits F and G combined indicate eight wells will be either completely or partially <br /> mined through. The DRMS requires acknowledgment and acceptance of this from each well <br /> owner. <br /> These 8 well are owned by Schubert Ranch the owners of the property, that Ellicott Sand <br /> & Gravel LLC has leased the mining area from. Ellicott Sand & Gravel LLC will commit to <br /> not mining within 200 feet of any of the 8 wells that could be disturbed by mining until an <br />
