PERMIT#:M-1998-071 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: September 4,2019 <br /> OBSERVATIONS <br /> This was a routine monitoring inspection of the Fryrear Gravel Pit, an 80 acre 112c sand and gravel permit with <br /> a post mining land use of wildlife habitat. The site is located approximately 22 miles north-northeast of Yuma <br /> CO on the northeast corner of the intersection of County Road N and County Road 59. DRMS representative <br /> Eric Scott met with permittee Justin Kuntz at the site entrance and toured the active area of the site with him. <br /> The site identification sign was present at the site entrance as required (photo 1). <br /> The permit lies within a farmed, intermittent drainage that flows from the northwest corner to the southeast <br /> corner of the permit. Approximately 18 acres near the center of the permit area are actively being mined in a <br /> series of different excavations crossed by haul roads (photos 2, 3 and 5). Areas within the permit area that <br /> have not yet been affected by mining activity are still utilized as agricultural land, and the SE corner of the <br /> permit area has been re-sloped and successfully revegetated (photo 4). <br /> Two issues were observed during this inspection that will require the permittee/operator to take corrective <br /> actions. On the first page of this report, these issues are identified and summarized, corrective actions have <br /> been given, and corrective action due dates have been specified. <br /> 1) The site is improperly impounding surface runoff. Due the location of the site, within the path of an <br /> intermittent drainage, this will be an ongoing issue if not properly addressed. The issue will be especially <br /> pronounced in years, such as this one, where the precipitation in the area has been significantly above <br /> average. Unless approval can be obtained from the State Engineer's Office to retain surface runoff within the <br /> permit area, special attention will need to be given to managing and minimizing run-on into the site, and <br /> ensuring that any intercepted and impounded surface water either infiltrates, or is discharged (pumped) back <br /> into the natural drainage within the allowable 72 hour timeframe. <br /> 2)The operator is not following the approved mining plan at this time. The mining plan as approved in TR01 in <br /> June of 2016 states that mining phases will be maintained at 3H:1V with the exception of the active mining <br /> face which will be limited to a maximum height of 25 feet, and maximum length of 300 feet (see item #1 of the <br /> attached TR01 submittal). Based on aerial photography of the site DRMS estimates that there are currently at <br /> least 1,850 feet of highwall existing at the site over the existing affected area which would require re-sloping. <br /> The operator will be required to re-slope all but 300 feet of the existing highwalls of the active mining areas to <br /> 3H:1V to achieve compliance with the approved mining plan. The operator may also submit a TR to revise the <br /> mining plan to allow for an increase in the allowable active highwall length. If submitted, the TR will need to <br /> include the length of proposed highwall and information suitable for the Division to calculate the required <br /> bond increase.
