1 <br /> I , <br /> ENVIRONMENTAL CONSOLTING <br /> May 29, 2019 <br /> Noble Midstream <br /> 2115 117th Ave <br /> Greeley CO, 80631 <br /> Subject: Resend of Structure Agreement for Certification Filing—Mine Permit Application for Arnolds <br /> Custom Seeding <br /> Duraroot, LLC, on behalf of Arnolds Custom Seeding, is converting the existing 110 Mine Permit <br /> M-2106-022 to a 112 Mine Permit due to the expanded operation. <br /> The enclosed Notice is being sent to you because Noble Midstream owns an underground <br /> waterline underlying the mine property in the northwestern corner. The location of the subject <br /> property is part of the Northwest% of the Northwest% of Section 35, Township 2 North, Range 63 <br /> West in Weld County, Colorado. Arnolds Custom Seeding, LLC is in the process of filing for a 112 <br /> Reclamation Permit Application with the Colorado Division of Reclamation, Mining and Safety. The <br /> Arnold Pit No. 1 reclamation plan is to return the area disturbance back to crop production. <br /> The underground waterline that Noble owns is located in the southwest corner of the mine property. <br /> The area to be mined is located over the waterline. Mining will take place within the top 12 inches <br /> of topsoil and will be staked prior to disturbance. There will be no reason the waterline should be <br /> disturbed during the mine process. Upon approval of the Mine Permit an 811 locate will be called in. <br /> Enclosed with this letter is a "Structure Agreement" whereby Arnolds Custom Seeding, LLC agrees to <br /> provide compensation for any damages to the referenced waterline as the result of mining top soil <br /> from the subject property (see map attached).
