("Tri-State") is the parent <br /> company to Elk Ridge Mining and Reclamation, LCC (ERMR)New Horizon Mine. The New <br /> Horizon Mine operates under the Division of Reclamation, Mining and Safety (DRMS) Permit <br /> No. C-1981-008. <br /> Rule 1.04(71) states, "...All of the land uses defined below may include land used for <br /> support facilities which are adjacent to, or are an integral part of the land..." Tri-State, therefore, <br /> requests retention of a 3.5-acre parcel of irrigated pasture north of BB County Road and east of <br /> 2700 Road as an adjacent support facility area. The area is shown on Map 2.05.4-5 of the permit <br /> application package. Retention of this area provides a great benefit to Tri-State's private <br /> property and supports the post mine land directly adjacent to this area. <br /> I, Michael G. Sorensen, as representative of Tri-State and the surface landowner, hereby <br /> request that the 3.5-acre area noted above be an adjacent support facility area as defined in Rule <br /> 1.04(71). This adjacent support facility area is an integral part of Tri-State's land management <br /> activities on its property and will be extremely beneficial for post mine land use in the area. <br /> Please feel free to call Tony Tennyson at 970-824-1232 or myself at 303-254-3208.
