RE: J-2 Contracting Company—DPG Pit—Permit No. M-2019-028 <br /> 112(c) Permit Application <br /> Adequacy Review No. 1 Response 8126119 <br /> -3- <br /> "Floodplain" for the Cache La Poudre and South Platte Rivers. Please specify the type of <br /> floodway and floodplain on these maps (e.g., 100-year, 500-year). <br /> Response: The floodway and floodplain locations have been labeled to specify that they <br /> are the 100-year floodway and floodplain as designated from the Colorado Hazard <br /> Mapping Program (CHAMP) study that is being conducted for this area. <br /> 11) Please identify the proposed fuel storage location(s) on Exhibits C-4 and C-5 Mining Plan <br /> Maps. <br /> Response: The locations have been revised and labeled on the revised Exhibit C-4 and <br /> C-5 maps. <br /> 12) The Phase 4 acreage shown on Exhibit C-4 — Mining Plan Map (44.1 acres) is different <br /> than the Phase 4 acreage shown on Exhibit C-5 — Mining Plan Map (45.4 acres). Please <br /> explain and/or correct this discrepancy on the appropriate map. <br /> Response: The acreage numbers have been updated and corrected on the revised <br /> Exhibit C-4 and C-5 maps. <br /> Exhibit D— Mining Plan (Rule 6.4.4): <br /> 13) The operator states the proposed permit area is 228.02 acres, with approximately 190.37 <br /> acres being mined, and the remaining area consisting of setbacks, road and utility right-of- <br /> ways, equipment storage, and plant site access. Please specify the proposed affected <br /> area if it differs from the proposed permit area, including all lands to be affected by the <br /> operation (e.g., mining, stockpiling, processing, slurry wall installation, stormwater control <br /> structures, sediment ponds, equipment storage, scale/scale house, improved or newly <br /> constructed access/haul roads). <br /> Response: The proposed affected area and the permit area are the same at 227.52 acres. <br /> The acreage and boundary were updated so the total acreage is slightly different. <br /> 14) Please specify the proposed maximum disturbance (in acres) for which the operator is <br /> proposing to post a financial warranty at this time. If this acreage does not include the <br /> entire proposed affected lands, please commit to submitting a Technical Revision to <br /> increase the maximum disturbed area and revise the bond estimate accordingly prior to <br /> creating additional disturbance. <br /> Response: The proposed maximum disturbed area has been calculated for the initial <br /> mining phase and areas that will be disturbed. The financial warranty calculations have <br /> been updated to reflect this. J-2 Contracting Company commits to submitting a Technical <br /> Revision to increase the maximum disturbed area and revise the bond estimate prior to <br /> creating additional disturbance. <br /> 15) If the proposed maximum disturbance at this time will occur in more than one of the five <br /> proposed mining phases, please specify the type and estimated amount of disturbance to <br /> occur in each phase (e.g., 45 acres — mining — Phases 1 and 2; 15 acres — <br /> processing/stockpiling — Phases 3 and 4).
