<br /> No issues with surface stability were noted, such as erosional features or slumping, but with
<br /> regard to backfill and regrading to approximate original contour, to include removing hydrologic
<br /> control structures and stockpiled materials, several unreclaimed sediment ponds and associated
<br /> topsoil stockpiles were observed on this parcel. According to the SL-4 application, "a permanent
<br /> sediment pond demonstration was submitted and approved in 1992 for sediment pond 9A-P 1. No
<br /> other sediment ponds have had demonstrations to show their post mining land use value."
<br /> Application at 20. No issues were observed with pond 9A-P 1 which would interfere with its
<br /> function as a permanently retained feature. Ponds 9A-P2, 9A-P3, 9A-P4 and their associated
<br /> topsoil stockpiles have not been reclaimed or approved as permanent features and do not meet
<br /> the criteria for Phase I, II, or III bond release. See Figures 6— 9.
<br /> Conclusion
<br /> The reclaimed Utah Tract of the Williams Fork Mine proposed for Phase I, II, and III bond
<br /> release under SL-4 is consistent with the approved reclamation plan, supports the wildlife habitat
<br /> / livestock grazing PMLU, and meets the requirements for Phase I, II, and III bond release. On
<br /> the whole, the SMCRA-permitted and disturbed portion within the Williams Fork Mine Strip Pit
<br /> parcel evaluated under SL-4 does not meet the requirements for Phase I, II, or III bond release at
<br /> this time. No enforcement actions were taken as a result of this inspection, nor are any pending.
