McAtee Construction Company Page 2 <br /> Riverside Pit - M-1976-056 August 20, 2019 <br /> Office of Archaeology & Historic Preservation <br /> Thank you for the information and if human remains are found when mining is taking place <br /> the Logan County Sheriff will be contacted. <br /> U.S. Army Corps of Engineers <br /> We wish to thank Mr. Laux for taking the time to review our permit application, provides <br /> contact information and make suggestions. The items he mention have been done in the <br /> past and are being updated as needed. In particular water exposed by this operation is <br /> currently covered by a Well Permit (#66811) and an augmentation plan (2017CW3062). It <br /> will be updated prior to exposing more water surface area then currently allowed. We <br /> have a permit to discharge stormwater and nothing is released into state waters. This is <br /> an existing mine in a heavy industrial area that was used as an old cattle feedlot and the <br /> existing operation can have no more impacts to wildlife then what have existed for 50 plus <br /> years. The Colorado Parks and Wildlife was contacted prior to mining beginning in 1976 <br /> and no issues were noted at that time. The impact to the flood zone is minimal as the <br /> changes will not increase the flood elevations. No dredge or fill will be placed in water of <br /> the US nor will wetlands be impacted as none exist on the site that have not been built <br /> during reclamation. <br /> 6.4 Specific Exhibit Requirements - Regular 112 Operations <br /> The following items must be addressed by the Applicant in order to satisfy the requirements of <br /> C.R.S. 34-32.5-101 et seq. and the Mineral Rules and Regulations of the Mined Land <br /> Reclamation Board: <br /> 6.4.3 Exhibit C - Pre-mining and Mining Plan Maps of Affected Lands <br /> 4. Please update the Exhibit C maps to indicate the 40 feet offset from each side of the <br /> centerline of the Xcel Energy owned overhead powerlines. <br /> Attached are copies of the revised Map C - Pre-Mining and Map C-1 - Mining Plan maps <br /> showing the offsets along the power lines. <br /> 5. Please update the Exhibit C maps to indicate the 200 feet offset from the buried <br /> powerline adjacent to the east permit line on the West Area until a structure agreement is <br /> signed by the utility owner. <br /> The plan is to mine within 200 feet of any structure either under an agreement with the <br /> owners (in this case Xcel Energy) or thru proof that the mining and final slope setback <br /> distances have factors of safety greater then 1.5 thru the Geotechnical Analysis (GA) <br /> presented. The GA is used in place of, the structural agreement if it is not returned. <br /> FYI, this power line was buried after the permit was amended in August of 2000 and <br /> McAtee Construction Company asked to have it buried, Xcel was fully aware it was going to <br /> be mined next to. This was not added to the map. <br />
