14� MINING METHODS — Only mining methods that will insure the extraction of the greatest possible <br /> amount of minerals consistent within the laws and with prevailing good mining practice shalt be <br /> used. <br /> 15. OPERATION PLAN — ALL plans for exploration and mining shalt be submitted to Lessor for approval <br /> by Lessor before such operations begin. These plans will include, but not be Limited to, Location of <br /> additional roads, Location of access points to the Leased Premises, and Location n/ any cattle guards <br /> or gates. These plans shalt include provisions for control of noxious weeds on all lands disturbed by <br /> the Lessee, and along at[ transportation corridors used by the Lessee within the Leased Premises. <br /> Lessee shalt provide evidence of consultation with Colorado Parks and Wildlife and incorporate <br /> provisions for protection of wildlife. Lessee will adhere to all wildlife restrictions as outlined on <br /> Euhibit[. <br /> 16. ENVIRONMENTAL ANALYSIS — Lessee shalt comply with all applicable federal, state, and local laws, <br /> ruies, regulations, permits' codes and ordinances, including the rules, regulations and requirements <br /> of the [oioraduDivision of Reclamation, Mining and Safety to identify and reduce adverse impacts to <br /> the environment, and the public heuith, safety and welfare. Prior to any surface occupancy on the <br /> Leased Premises, Lessee must perform environmental analyses that are required by any local, state <br /> or federal agency or regulation, including, but not limited to, the study of the impacts of the mining <br /> operation onvviidhfp' air' water, soil, or other biological resources. Lessor may require that Lessee <br /> submit the environmental analysis, including proposed mitigation plans, for review by Lessor before <br /> any exploration or mining begins. <br /> 17. RECLAMATION -' Lessee shalt submit all plans for restoration and reclamation of Leased Premises to <br /> Lessor for Lessor's approval before submitting the appropriate permit or permits pursuant to the <br /> Colorado Mined Land Reclamation Act 34'32'101 ETSEQ.. C.R.S. 1973 as amended. Rules and <br /> regulations as set forth by the Division of Reclamation, Mining, and Safety for recovery and <br /> restoration of mined land will apply where applicable to the Leased Premises. Variations from the <br /> reclamation plan as originally submitted for approval may be granted only with the written approval <br /> of Lessor. <br /> 18. '- Whenever approval by Lessor is required or contemplated by Lessee, <br /> approval must be in writing and shalt be optional and shalt be within the sole and absolute discretion <br /> of Lessor. <br /> 19. OTHER STATE AGENCIES -- Lessor may determine that instruments and documents required by other <br /> State agencies satisfy certain requirements nfthis [ease. In the event that Lessee is required to file <br /> instruments and documents with other State agencies, including the Division of Reclamation, Mining, <br /> and Safety, Lessee shalt notify Lessor of said filing and Lessor reserves the right to request and <br /> obtain copies of such instruments and documents from the agency or from Lessee. <br /> 20. NOTICES '' Any notice, demand, request, designation, consent' approval or other document or <br /> instrument required under the provisions of this Lease shalt be in writing, shalt be deemed to have <br /> been duty served on the day of receipt or rejection and shalt be sent by registered or certified <br /> United States mail, postage prepaid' return receipt requested, or by u nationally recognized <br /> overnight courier service that provides written evidence of delivery, as addressed to the Parties <br /> hereto.
