Proof of Mailings of Structure Agreements Dear Mr. Scott: Per your email dated July 16,2019 regarding Arcosa's request for succession of operator application, we are providing proof of mailings of damage waiver agreements. In accordance with Sections 6.3.12(a) of the Mineral Rules and Regulations,damage waiver agreements were sought with the following owners of permanent and manmade structures within 200 feet of the proposed affected lands boundary for Arcosa's permit number M-1988-108 amendment application. • Colorado Department of Transportation • US Department of Energy—National Renewable Energy Lab • Lamar Advertising • Excel Energy • Century Link • Old Tyme Saw Mill;John Sainsbury • Hogan Family • Mountain Plains Industrial Center,LLC. • JoAnn T Sharp Revocable Trust;Bill Hogan Living Trust Please find proof of mailings for the proposed structure agreements enclosed herewith. With this letter we are: (a) providing the Division of Reclamation and Mining Safety (DRMS) a copy of the certified mail receipts for each structure agreement that was mailed to owners of record of such structures within 200 feet of the affected lands boundary; (b) providing DRMS a copy of the agreements sent via certified mail, which include notarized signatures from Arcosa;and (c) notifying the DRMS that,to date we have not received signed structure agreements back from any party although we expect to receive a signed damage waiver agreement from the Colorado Department of Transportation for the Highway 93 right-of-way. A summary of the status of each structure agreement,including certified mail tracking numbers,is provided below. 1
