Pond 3 is primarily located in <br /> the NE1/4 of the SW1/4, the NW1/4 of the SE1/4, the SE1/4 of the SW1/4 and the SW1/4 of the SE1/4 <br /> Section 1, Township 4 North, Range 67 West of the 6th P.M., and is part of the Bernhardt Pit gravel pit (DRMS <br /> M-2002-120). Pond 3 was lined with a soil bentonite slurry wall. The slurry wall leak test commenced on <br /> October 1, 2015 and concluded on January 13, 2016. Site inspection was performed by our office on January <br /> 26, 2016 to review site conditions and discuss the results obtained from the data collected during the test. <br /> Your report dated February 18, 2016 provides the liner summary and leak test results. The test data <br /> provided indicates that the reservoir has been lined to the performance standard referenced in the August <br /> 1999 State Engineer Guidelines for Lining Criteria for Gravel Pits (1999 SEO Guidelines). Meeting the <br /> performance standard requires that during reservoir (pond) operations all water inflows and outflows for <br /> the liner perimeter enclosed area be accounted for on a weekly basis. <br /> With this liner approval, Pond 3 of the Bernhardt Pit is now classified as a lined reservoir in accordance with <br /> the 1999 SEO Guidelines. Water shall not be impounded in the reservoir except pursuant to lawful diversions <br /> allowed by statute or decree. At all other times, all inflow of water into the reservoir from any source, <br /> including precipitation and ground water inflows shall be removed to prevent illegal storage of water.
