Dear Mr. Rodriguez:
The purpose of this letter is to approve the lining of the Bernhardt Pit (Pond 3). Pond 3 is primarily located in
the NE1/4 of the SW1/4, the NW1/4 of the SE1/4, the SE1/4 of the SW1/4 and the SW1/4 of the SE1/4
Section 1, Township 4 North, Range 67 West of the 6th P.M., and is part of the Bernhardt Pit gravel pit (DRMS
M-2002-120). Pond 3 was lined with a soil bentonite slurry wall. The slurry wall leak test commenced on
October 1, 2015 and concluded on January 13, 2016. Site inspection was performed by our office on January
26, 2016 to review site conditions and discuss the results obtained from the data collected during the test.
Your report dated February 18, 2016 provides the liner summary and leak test results. The test data
provided indicates that the reservoir has been lined to the performance standard referenced in the August
1999 State Engineer Guidelines for Lining Criteria for Gravel Pits (1999 SEO Guidelines). Meeting the
performance standard requires that during reservoir (pond) operations all water inflows and outflows for
the liner perimeter enclosed area be accounted for on a weekly basis.
With this liner approval, Pond 3 of the Bernhardt Pit is now classified as a lined reservoir in accordance with
the 1999 SEO Guidelines. Water shall not be impounded in the reservoir except pursuant to lawful diversions
allowed by statute or decree. At all other times, all inflow of water into the reservoir from any source,
including precipitation and ground water inflows shall be removed to prevent illegal storage of water. Prior
to ANY use of this site, the owner or operator will need to coordinate with Jean Lever, District 4 Water
Commissioner, to review operations, measurement structures, stage-storage curves, and accounting.
