Biological Survey Report <br /> Black Mountain Sand Weld LLC—Lost Creek Mine <br /> applied around the identified burrows, until such time that the young have fledged or are no longer <br /> present. <br /> The swift fox is listed as a state species of concern,which does not afford statutory protection; however, <br /> the CPW may provide recommendations for impact minimization, as such, coordination with the CPW is <br /> recommended. <br /> 4.3 MIGRATORY BIRDS <br /> Measures to comply with federal regulatory rules for the BGEPA include scheduling vegetation removal, <br /> trimming, and/or grading of vegetated areas outside of the peak bird breeding or roosting seasons.When <br /> Project activities cannot occur outside the bird nesting season, surveys should be conducted prior to <br /> scheduled activity to determine if active nests are present within the area of impact. Generally, the <br /> surveys should be conducted no more than seven days priorto scheduled activity. If found,no disturbance <br /> is permitted, however; buffers could be identified around nests to avoid impacts. <br /> For the other migratory birds, if construction activities occur within the nesting season,TRC recommends <br /> that focused migratory bird and raptor surveys be conducted to identify active nests within the survey <br /> area.
