Submittal of Bond Release Application and Completeness Determination by the Division <br /> TMI submitted the bond release application following the procedures described in the Act and Regulations. <br /> The application also utilized the Division's Guideline Regarding Selected Coal Mine Bond Release Issues, <br /> dated April 18, 1995. <br /> The Division received TMI's Phase I bond release application, SL18, on 14 February 2017, and found the <br /> application complete on 7 March 2017,after the Division received proof of publication of the applicant's public <br /> notice. The completeness determination was made in accordance with Section 3.03.2(1)(d). Map 1, entitled <br /> SL-18 Phase II Bond Release Area Delineation and submitted with the application, shows the location of each <br /> parcel. <br /> Public Notice <br /> TMI published notice of the bond release application in the Craig Daily Press once weekly for four consecutive <br /> weeks, beginning on 1 March 2017. TMI also notified landowners within and adjacent to the mine permit <br /> area, and other interested parties, of the application for bond release, as required by Section 3.03.2(1). The <br /> Division received no written comments, objections, or requests for an informal conference regarding the bond <br /> release application. <br /> Bond Release Inspection <br /> The Division conducted the bond release inspection evaluating post-mine topography on the SL 18 <br /> parcels on 29 August 2017 in accordance with Section 3.03.2(2). Details of the Division's <br /> observations during the inspection can be found in the inspection report. <br /> The Division notified the operator,surface owners,Bureau of Land Management(BLM),the Office of Surface <br /> Mining(OSM), and the Colorado State Land Board of the inspection via certified mail. (TMI) <br /> On 26 September 2017, DRMS sent the SL18 bond release inspection report to TMI, BLM, OSM and the <br /> Colorado State Land Board. <br /> Adequacy Review <br /> Issues discussed during the inspection consisted of erosion concerns in portions of the east and west branches <br /> of the drainage in parcel ZAB 16. The operator addressed the problematic areas making the requisite repairs <br /> within the month. DRMS, on subsequent inspection, deemed the repairs adequate. DRMS inspection reports <br /> document the issues and repairs made. <br /> Trapper constructs drainages on newly deposited spoil, consisting of relatively unconsolidated rock and soil <br /> comprised of the overburden material removed in the mining process in accessing the coal seam. The drainages <br /> are excavated to the width of a dozer blade and configured to a trapezoidal shape.
