Oxbow is both the Landowner and Permittee. <br /> Oxbow desires to establish an RV/Boat storage facility, at the former Terror Creek Loadout <br /> property. This is an IndustriahCommercial Post-mining Land Use. The Reclamation plan will <br /> leave the facility pads at the property in the present configuration, while demolishing concrete walls <br /> and footers, and filling holes and tunnels. There continues to be outside interest about leasing or <br /> purchasing the property for uses other than an RV\Boat storage which are also being entertained by <br /> Oxbow. These alternate uses also require the pads be left in the present configuration and the Post- <br /> mining Land use be Industrial\Commercial. <br /> The Terror Creek Company was permitted to begin comminution, coal sizing and rail or truck <br /> loading in 1984. This commercial/industrial use activity continued to operate for some 30 years, <br /> until the facility was idled in 2013 and 2014. In 2015, equipment was removed from the property <br /> and the facility was permanently closed. Oxbow continues to actively pursue alternate <br /> commercial/industrial uses for the property. Oxbow feels that the close availability of three phase <br /> power, the existing facility bench, availability to rail access, and availability of fiber optic services <br /> make post mining use of this property more suited for a continued industrial/commercial use. <br /> Presently,the permitted Post Mining Land Use for the property is to transform the main portion of <br /> the property,the 7 acre facilities pad, into an irrigated hay field. The office and outbuilding, and <br /> shop foundation(40'x80') are permitted to remain in place, as is the main haul road down to the <br /> intersection with the office access road. The access road to the shop\office area and the expanded <br /> (widened) area of the access road will also be retained. The areas to be left in place was anticipated <br /> to be used by a future owner for hay and equipment storage and residential purposes. <br /> Oxbow continues to receive alternate post mine use proposals from outside individuals and has <br /> explored several alternate use avenues itself. During the 2014 to 2015 home heating season, <br /> Farnsworth Construction and Gravel Company leased the facilities pad to screen coal, transported <br /> 0 Page 12 <br />
