BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE REQUEST OF RIO GRANDE SILVER, INC. <br /> FOR A SECOND FIVE-YEAR PERIOD OF TEMPORARY CESSATION, <br /> File No. M-1977-215 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> June 26, 2019 in Denver for a hearing to consider the request for a second <br /> consecutive five-year period of temporary cessation filed by Rio Grande Silver, Inc. <br /> ("Operator") for the Bulldog Mine Operation, file number M-1977-215. Stephanie <br /> Mitchell appeared on behalf of the Division of Reclamation, Mining and Safety <br /> ("Division"). Randy McClure appeared on behalf of Operator. <br /> The Board, having considered the presentations, testimony, and evidence of <br /> the Division' and Operator, and being otherwise fully informed of the facts of the <br /> matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112 d-2 reclamation permit for 568 acres of silver <br /> p ( ) <br /> and lead g p mining. The site is known as the Bulldog Mine Operation. The site is a <br /> g <br /> designated mining operation and is located in Mineral County, Township 42 North, <br /> Range 1 West, Section 35, loth Principal Meridian. <br /> 2. On March 26, 2014, the Division accepted Operator's notice for the first <br /> period of Temporary Cessation ("TC-1") for the site, with an effective date of <br /> December 31, 2013. <br /> 3. On March 15, 2019, Operator submitted a request for a second <br /> consecutive period of Temporary Cessation ("TC-2") for the site. <br /> 4. On May 28, 2019, the Division inspected the site as required by Rule <br /> 1.13.15(4) of the Mineral Rules and Regulations of the Colorado Mined Land <br /> Reclamation Board ("Rules"), <br /> 5. The Division holds a financial warranty for the site in the amount of <br /> $163,228.13. The financial warranty is adequate to reclaim the site. <br /> 1 The Division was advisory staff to the Board, not a party, in this proceeding. <br />
