BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE REQUEST OF FREMONT PAVING & REDI- <br /> MIX, INC. FOR A SECOND PERIOD OF TEMPORARY CESSATION, <br /> File No. M-2000-151 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> June 25, 2019 in Denver for a hearing to consider the request for a second period of <br /> temporary cessation filed by Fremont Paving & Redi-Mix, Inc. ("Operator"), file <br /> number M-2000-151 ("permit"). Tim Cazier appeared on behalf of the Division of <br /> Reclamation, Mining and Safety ("Division"). Jodi Schreiber appeared on behalf of <br /> Operator. <br /> The Board, having considered the presentations, testimony, and evidence of <br /> the Division' and Operator, and being otherwise fully informed of the facts in the <br /> matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c) reclamation permit for 231.12 acres of sand <br /> and gravel mining. The site is known as the McCumber Hill Pit. The site is a <br /> designated sand and gravel operation and is located in Fremont County, Township <br /> 19S, Range 70W, Section 12. <br /> 2. The Division accepted Operator's notice for the first period of <br /> Temporary Cessation ("TC-1") for the site, with an effective date of April 30, 2014. <br /> 3. On March 20, 2019, the Division performed regular monitoring <br /> inspection. The Division indicated to the Operator that the first period of <br /> Temporary Cessation would expire on April 29, 2019. The Division found no <br /> problems or violations at the site during the inspection. <br /> 4. On April 23, 2019, the Division received a request for a second period <br /> of Temporary Cessation ("TC-2") for the site. <br /> 1 The Division was advisory staff to the Board, not a party, in this proceeding. <br />
