Please provide the SLOPE/W data performed by Tetra Tech to allow the Division to duplicate the <br /> analysis with Clover Technology's Galena software for verification purposes. <br /> The files of updated slope stability analysis performed in response to these comments are <br /> provided with this submittal. <br /> The Division will verify the Applicant's stability analysis models using Clover Technology's Galena v7.1 <br /> slope stability software following the Applicant's response to this letter. <br /> Rule 1.6.2(1)(d) and (e), Notification Requirements <br /> 42. In accordance with Rule 1.6.2(1)(e), the Applicant shall serve a copy of the notice required by Rule <br /> 1.6.2(1)(d) immediately after the first publication to the Owners of Record of all land surface within <br /> 200 feet of the boundary of the affected land. The Division could not locate documentation the <br /> required notice was served to Kathleen Bloom a property owner that appears to be within 200 feet <br /> of the affected land of the South Area. Please provide documentation this party was served the <br /> required notice immediately after the first publication. <br /> Kathy Bloom was inadvertently left off of the notification list. Notice was hand delivered to <br /> Kathleen Bloom by Barb Brunk on January 24, 2019 indicating that she had until March 6, <br /> 2019 to provide written comments to the Division. <br /> Comments <br /> 43. The Division has forwarded you comments received from the following agencies: Division of Water <br /> Resources (dated December 12, 2018), Office of Archaeology and Historic Preservation (dated <br /> December 7, 2018) and the USACE (dated December 31, 2018). Please review these comments <br /> and address any concerns identified. <br /> Colorado Division of Water Resources <br /> 1. COMMENTS: The purpose of this amendment is to add 16.2 acres to the existing 291.5 <br /> permitted acres, for a total of 307.7 permitted acres. The proposed operation will consume <br /> ground water through evaporation, dust control, reclamation, water removed with the mined <br /> product, processing, dewatering and water used for the construction of slurry wall for the West <br /> and the East cells. In accordance with Section 37-90-137(2) and (11), C.R.S., the applicant <br /> obtained a substitute water supply plan ("SWSP") and well permit no. 81342-F. Currently there <br /> are 2 acres of exposed ground water at the site, that were excavated under Tucson Resource <br /> Mine, Permit No. M-1991-140. The evaporation depletions from the 2 acres are covered by the <br /> existing SWSP approved for the Tucson South Resource Mine, Permit No. M-2004-044-140. If <br /> additional acreage will be exposed beyond what is allowed by the SWSP or the well permit no. <br /> 81342-F, the applicant will need to obtain a new SWSP and a new well permit. So long as the <br /> amended Tucson South Resource Pit is operated in accordance with an approved SWSP or <br /> approved plan for augmentation, this office has no objection to the amendment request. Any <br /> storm water runoff intercepted by this operation that is not diverted or captured in priority must <br /> infiltrate into the ground or be released to the stream system within 72 hours. Otherwise, the <br /> operator will be required to make replacements for evaporation.
