Case R'o. 09CW105 <br /> Findings of Fact, Conclusions of Law, <br /> Judgment and Decree <br /> Page 17 of 28 <br /> possessed and controlled and will be beneficially used and the project can and will be <br /> completed with diligence and within a reasonable time. <br /> 31. Loveland Ready Mix has demonstrated a specific plan and intent to divert, store, <br /> and otherwise capture, possess and control water in the amounts set forth in Paragraph 28, <br /> above, and that such water can and will be beneficially used for the beneficial uses, as <br /> described in Paragraph 24, above. <br /> 32. Loveland Ready Mix has proceeded with reasonable diligence to complete the <br /> appropriations from the dates of initiation through the date of this decree. <br /> PLAN FOR AUGMENTATION <br /> 33. Structures to be Augmented: <br /> 33.1 Walters and Bokelman Pits. Located in the SW`/4 of the NE'/4, the SE'/4, <br /> and the E'/2SW'/a, Section 24, T5N, R68W, 6th P.M., Larimer County, Colorado, as shown <br /> on the attached Exhibit B. <br /> 33.1.1 Gravel pits located in Walters Cells 1, 2 and 3 will be inside a slurry <br /> wall that does not intercept ground water, and therefore, these gravel pits shall be <br /> lined pits that do not require augmentation. Gravel pits located in Walters Cell 4 <br /> will be unlined and therefore evaporative depletions from ground water exposed in <br /> these gravel pits shall be augmented pursuant to the plan for augmentation decreed <br /> herein. Gravel pits located in Bokelman Cells 1, 2 and 3 will be inside a slurry wall <br /> that does not intercept ground water, and therefore, these gravel pits shall be lined <br /> pits that do not require augmentation. LRM shall replace out of priority evaporative <br /> depletions at each gravel pit until the State or Division Engineer approves the liner <br /> for each pit. <br /> 33.2 Green and Croissant Pits. Located in the NW'/4 and the W'/z of the NE'/4, <br /> F Section 30, T5N, R67W, 6`h P.M., Weld County, Colorado, as shown on the attached <br /> Exhibit B. <br /> 33.2.1 Gravel pits located in all four cells at the Green and Croissant Pits <br /> site will be unlined and therefore evaporative depletions from ground water <br /> exposed in these gravel pits will be augmented pursuant to the plan for <br /> augmentation decreed herein. <br /> 34. Uses: Unlined gravel pits at the Walters and Bokelman Pits site and the Green and <br /> Croissant Pits site ("Gravel Pits") expose tributary ground water. Out of priority <br /> evaporation losses from the unlined Gravel Pits must be replaced.
