(ASCI) is submitting this Technical Revision No. 5 (TR-05) to update <br /> the Exhibit C-2 —Mine Plan Maps for the Turnpike Mining Resource(Site). All nine (9) of the oil & <br /> gas (O&G) well locations present at the Site, owned by Extraction Oil & Gas, Inc. (Extraction), <br /> Foundation Energy Management LLC (Foundation), Noble Energy Corporation (Noble), and/or <br /> Kerr-McGee Oil & Gas Onshore LP (KMG) (a subsidiary of Anadarko Petroleum Corporation <br /> [APC]) (Extraction, Foundation, Noble, and KMG are referred to collectively as the "Petroleum <br /> Lessees"), have been Plugged and Abandoned (P&A) or Shut In (SI). Many of the flow lines and/or <br /> gathering lines associated with these wells have been removed. In addition, ASCI is not conducting <br /> asphalt and concrete recycling operations at the Site. Along with revising the Mine Plan Maps, ASCI <br /> is submitting an update to Exhibit D — Mining Plan Section (e) Approximate Mining Timetable to <br /> reflect the current conditions and anticipated mining schedule. <br /> Though the nine (9) O&G wells have been P&A or SI, according to the Surface Use Agreement <br /> (SUA) between ASCI and the Petroleum Lessees, the Petroleum Lessees have the right to drill a <br /> future well in each well pad area and maintain rights to pipeline easements and access right-of-way's <br /> (ROWS). Should the Petroleum Lessees choose to drill new wells in the future, the 75-foot mining <br /> setback and 200-foot backfill radii would once again become applicable, if ASCI is still mining the <br /> property. However, should mining be finished and reclamation of the Site is ongoing or complete, <br /> ASCI is still required to maintain a 200-foot distance from future well location. Therefore, the 200- <br /> foot boundaries around O&G well operational areas, along with pipeline easements and access <br /> ROWs, remain part of the reclamation plan for the Site. Since no change is required to the Exhibit F <br /> —Reclamation Plan Map, a revised map has not been submitted as part of this TR-05. <br />
