Re: Preliminary Adequacy Review New Horizon Mine, TR90
Dear Mr. Tennyson:
The Division has reviewed Elk Ridge Mining and Reclamation, LLC's (ERMR) application for a
technical revision for an incidental boundary change. ERMR is proposing to remove 3.59 acres
from the permit that have previously been approved for phase 1, phase II and final phase III bond
release. The Division concurs with the proposal to remove these phase III bond released acres
from the permit, the Division has several concerns regarding the revised pages submitted with
TR90.
1. At the top of page 1 of Attachment 2.03.8-1, the text states that, "The New Horizon 2
(NH2) Permit area consists of 6 separate parcels." Yet the following table describes eight
separate parcels. Please bring the text into agreement with the table.
2. The top of revised page 2.04.3-5 describes the permit boundary changes approved during
TR-85. This page also describes the removal of 3.59 acres of phase III bond released area
specific to TR-90. However, this page notes that the permitted acreage upon approval of
TR-90 will be 535.65 acres. This description of the permitted acreage fails to include the
New Horizon No. 1 acres that are still a part of the New Horizon permit (C1981-008).
Until the area specific to New Horizon No. 1 are approved to be removed from the New
Horizon mine permit,please include the 98.62 New Horizon No. 1 acres in this description.
The Division concurs with ERMR that the total permitted area after the approval of TR-90
will be 634.27 acres.
The value of 539.24 acres under "4.0 Description of Pre-Mine Land Use Areas" on this
page will need to be corrected as well.
3. On revised Table 2.04.3-1 Pre-Mine Land Use Areas by Type (page 2.04.3-7), and Table
2.04.3-2 Pre-Mine Land Use by Acreage and % of Total (page 2.04.3-8), please include a
