ERMR is proposing to remove 3.59 acres <br /> from the permit that have previously been approved for phase 1, phase II and final phase III bond <br /> release. The Division concurs with the proposal to remove these phase III bond released acres <br /> from the permit, the Division has several concerns regarding the revised pages submitted with <br /> TR90. <br /> 1. At the top of page 1 of Attachment 2.03.8-1, the text states that, "The New Horizon 2 <br /> (NH2) Permit area consists of 6 separate parcels." Yet the following table describes eight <br /> separate parcels. Please bring the text into agreement with the table. <br /> 2. The top of revised page 2.04.3-5 describes the permit boundary changes approved during <br /> TR-85. This page also describes the removal of 3.59 acres of phase III bond released area <br /> specific to TR-90. However, this page notes that the permitted acreage upon approval of <br /> TR-90 will be 535.65 acres. This description of the permitted acreage fails to include the <br /> New Horizon No. 1 acres that are still a part of the New Horizon permit (C1981-008). <br /> Until the area specific to New Horizon No. 1 are approved to be removed from the New <br /> Horizon mine permit,please include the 98.62 New Horizon No. 1 acres in this description. <br /> The Division concurs with ERMR that the total permitted area after the approval of TR-90 <br /> will be 634.27 acres. <br /> The value of 539.24 acres under "4.0 Description of Pre-Mine Land Use Areas" on this <br /> page will need to be corrected as well. <br /> 3.
