961079 04/24/2018 08.32 AM <br /> Page 7 of 18 <br /> 12.1. Plan Depletions. The maximum total surface area of the South Forty Ponds <br /> is 22.6 acres. There are 15.4 acres of this exposed surface area that is attributable to mined <br /> surface area existing as of December 30, 1980 and does not require augmentation in accordance <br /> with C.R.S. 37-90-137(11)(b). Therefore, of the total 22.6 acres of exposed surface area, the <br /> remaining 7.2 surface acres require replacement of out-of-priority stream depletions due to <br /> evaporation from the South Forty Ponds. South Forty's water resource engineers have calculated <br /> that the gross annual evaporation rate for the surface area of the South Forty Ponds is 3.83 annual <br /> acre feet per acre of surface area exposed. After reduction for effective precipitation, as allowed <br /> by C.R.S. 37-92-305(12), the annual net evaporation to be replaced is determined to be 3.1 acre <br /> feet per surface acre. Accordingly, the South Forty Ponds will cause maximum depletions to the <br /> Arkansas River of 22.32 annual acre feet consisting of the net annual evaporation of 3.1 acre feet <br /> per surface area multiplied by the post-1980 surface area of 7.2 acres. The annual and monthly <br /> evaporation calculations and distributions are shown on the attached Table 1. South Forty may <br /> reduce its replacement obligations when the South Forty Ponds are fully or partially covered by <br /> ice, as approved by the water commissioner and included in the accounting. <br /> 12.2. Lauin of f Depletions. The centroid of South Forty Ponds is located an <br /> average distance of approximately 700 feet from the Arkansas River. A Glover analysis has been <br /> performed by South Forty's water resource engineers to determine lagged depletions associated <br /> with the South Forty Ponds. The results of those lagged depletions to the Arkansas River <br /> throughout the year are as set forth in the attached Table 1 with the lagging factors set forth in <br /> Table 2. Due to the close proximity of the South Forty Ponds to the Arkansas River, the lagged <br /> depletions impact the Arkansas River at a location immediately adjacent to the South Forty <br /> Ponds. <br /> 12.3. Augmentation Water Releases. Replacement water, including releases <br /> from storage, shall be supplied to meet the monthly lagged depletions from South Forty's <br /> replacement sources at or above the calling water right, located downstream of the South Forty <br /> Ponds, to correspond with the amounts and timing of stream depletions to the Arkansas River, and <br /> thereby will prevent injury to vested water rights and conditional decreed water rights. <br /> Augmentation water releases will include releases from Pueblo Reservoir, or booking over <br /> water stored in Pueblo Reservoir to other storage accounts as determined by the Division <br /> Engineer's Office. At times that an intervening downstream call between the South Forty Ponds <br /> and Pueblo Reservoir prohibits the release or booking over of water from Pueblo Reservoir to <br /> replace depletions, South Forty will coordinate with Canon City and UAWCD in order to make <br /> augmentation releases from locations, including from storage, upstream of the calling water right. <br /> Releases of augmentation water to meet monthly depletions may be accumulated and released as <br /> directed by the Division Engineer's Office. <br /> In the event that the exposed surface area of the South Forty Ponds is reduced in the <br /> future, South Forty may report such reductions to the Division Engineer's Office along with <br /> Lindner/Aug Plan Appl/Pleadings/Mtn for Entry of ROR/Final ROR Decree 2-7-2018 Clean.doc 7 <br />
