Legal Description of Pond: In the SW 1/4 of the NW 1/4 and NW 1/4 <br /> of the SWl/4, Section 1, Township 19 South, Range 70 West of the 6th P.M., Fremont County, <br /> Colorado. <br /> 10.1.2. Source. Exposed alluvial groundwater as the result of previous <br /> gravel mining, tributary to the Arkansas River. <br /> 10.1.3. Surface Area of Pond. The maximum water surface area that may <br /> occur at high water line is 9.1 acres. <br /> 10.2. South Forty East Pond: <br /> 10.2.1. Leizal Description: SW1/4 of the NW1/4 and the N1/2 of the <br /> SW1/4, Section 1, Township 19 South, Range 70 West of the 61h P.M., Fremont County, <br /> Colorado. <br /> 10.2.2. Source: Exposed alluvial groundwater as the result of previous <br /> gravel mining, tributary to the Arkansas River. <br /> 10.2.3. Surface Area: The maximum water surface area that may occur at <br /> high water line is 13.5 acres. <br /> The WDID for the South Forty Ponds is 1205760 and the structure is located at 484361 E, <br /> 4252737 N (NAD 83). <br /> 11. Water Rights to Be Used for Augmentation. The water rights to be used for <br /> augmentation include fully consumable water supplies leased from the Upper Arkansas Water <br /> Conservancy District ("UAWCD"), including Twin Lakes shares, and also Fryingpan-Arkansas <br /> Project water allocated to Canon City and supplied to South Forty as a customer of Canon City. <br /> These water rights are described as follows: <br /> 11.1. Canon City Augmentation Water. On December 19, 2016, South Forty <br /> entered into a 30-year Municipal Water Users Agreement for a supply of augmentation water <br /> from Canon City supplied to South Forty as a water customer of Canon City. Under this <br /> Agreement, Canon City has agreed to provide fully consumable water for South Forty to use as an <br /> augmentation water supply to replace evaporative depletions from the South Forty Ponds.
