(SCC) <br />Bond Release Application No. 11 (SL-11) <br />Adequacy Review Comments <br />Permit No. C-1981-041 <br /> <br />Dear Mr. Wein: <br /> <br />The DRMS’ letter dated June 10, 2019, transmitted its adequacy comments regarding SL-11. <br />Following are SCC’s responses to the DRMS’ comments and concerns regarding Cedar Creek <br />Associates’ (CCA) Phase III Bond Release Evaluation found in Tab 8 of the bond application: <br /> <br />1. DRMS: On the bottom of page 6, it states that the “Perennial Herbaceous Production <br /> Success Standard – Achieve 90% of the perennial herbaceous production of the <br /> approved reference area.” This statement is inconsistent with the standard in the permit <br /> (page A14-11-1) which states “90% of the total herbaceous production of the approved <br /> reference area.” Please correct the standard in the application. <br /> <br /> SCC: Attached is revised page 6 of the “Phase III Bond Release Evaluation – Years 1 <br /> & 2” prepared for SCC by CCA. The last paragraph has been revised and explains the <br /> use of the alternative perennial herbaceous production. CCA used this alternative <br /> standard previously on the 2011 and 2012 Snowcap Phase III Bond Release Evaluation <br /> and the state accepted the use. <br /> <br />2. DRMS: The reclamation standard as stated in the permit for production measures the <br /> total herbaceous production. Snowcap is choosing to use perennial herbaceous <br /> production instead of total production as the standard. Please clarify why Snowcap is <br /> choosing to use this standard. <br /> <br /> SCC: Attached is revised page 6 of the “Phase III Bond Release Evaluation – Years 1 <br /> & 2” prepared for SCC by CCA. The last paragraph has been revised and clarifies why <br /> SCC is choosing to use the perennial herbaceous production standard. <br /> <br />3. DRMS: In the sample adequacy calculations on Tables 7, 8, 9 and 10, the t-values that <br /> were used (1.68 for 40 samples and 1.7 for 30 samples) are for a two-tailed test. Rule <br /> 4.15.11(2)(a) states that a one tail t-test is to be used in this calculation. Please re-
