<br /> <br /> <br />NOTICE OF PROPOSED DECISION <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision <br />Application No. 84 (TR-84) for the Foidel Creek Mine (Permit No. C-1982-056), submitted by <br />Twentymile Coal, LLC. Twentymile Coal, LLC. (TC) has submitted a revised version of a <br />technical revision application to obtain approval for the construction, operation, maintenance and <br />reclamation of a passive water treatment system to treat excess mine water discharge. Generally, <br />the excess mine water discharge will be water resulting from progressive dewatering of mine water <br />accumulations in the sealed and abandoned Wadge Seam mine workings in the Eastern and <br />Northern Mining District of the Foidel Creek Mine. The proposed passive treatment approach will <br />consist of a series of four constructed treatment cells, which will include both open water pond areas <br />and shallow constructed wetlands to provide physical, chemical and biological treatment in both <br />aerobic and anaerobic zones. The revised submittal moved the location of the proposed system to <br />an upland drainage to the north of the existing 6MN Water Storage Reservoir in the SW ¼ of <br />Section 17 Township 5 North Range 86 West of the 6th Principal Meridian. he water treatment <br />system will discharge to the 6MN reservoir, but the 6MN resevoir is not proposed to discharge with <br />this revision. The planned passive treatment system and associated structures will result in <br />approximately 19.0 acres of new surface disturbance on .1 acres of private land and 18.9 acres of <br />State owned land. The passive treatment system is proposed to remain in use as long as it is needed <br />to provide treatment for mine water discharge. Once discharge ceases, man-made discharge <br />structures will be removed and modifications will be made to the cell embankments to provide for <br />flow through, with the cells and associated ponded areas and wetlands remaining as permanent <br />habitat enhancement features. <br /> <br />The Foidel Creek Mine is a/an underground coal mine located in Routt County, approximately 23 <br />miles SW of Steamboat Springs, Colorado. Coal interest is federal, state and private, and the <br />surface affected is federal, state and private land. The permit area encompasses approximately <br />22,647.00 acres. <br /> <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., <br />C.R.S., and the regulations promulgated thereunder. <br /> <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the <br />Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 <br />Sherman Street, Denver, Colorado 80203. Persons with an interest that may be adversely affected <br />by the proposed decision may request a formal hearing before the Mined Land Reclamation Board <br />on the proposed decision. Such request must be made within ten (10) days of the initial publication <br />of this notice, must be in writing, and must state with reasonable specificity the reasons for the <br />request and the objections to the proposed decision. <br /> <br />
