PERMIT #: M-2019-016 <br />INSPECTOR'S INITIALS: SJM <br />INSPECTION DATE: May 28, 2019 <br />OBSERVATIONS <br />This was a pre-operation inspection conducted by the Division of Reclamation, Mining and Safety (Division) in <br />response to the Construction Material Regular 110c Operation Reclamation permit application submitted by <br />David Smith of Boot Jack Ranch, LLC. David Smith, the applicant, was present during the inspection. <br />Photographs taken at the site during this inspection are included at the end of this report. <br />The Boot Jack Ranch River Rock Processing Area is located 10 miles north of Pagosa Springs in Mineral County <br />and will be accessed from HWY 160 via the Boot Jack Ranch. <br />The appropriate public notice sign was NOT in place. This is a requirement per Rule 1.6.2 <br />The current site use is a stockpile yard and equipment yard. The post mining land use will be Wildlife. The <br />permit area will include 1.84 acres. Both the current site use and postmining land use were listed as Wildlife <br />Habitat. The Division finds that this is not accurate since the yard is not currently wildlife habitat and the yard <br />will remain an equipment/rock storage yard for years to come. <br />Currently, there is a very large stockpile of river rock and large boulders on site. There is also equipment <br />stored within the permit boundary. <br />This inspection confirmed that the site conditions were not accurately portrayed in the application package <br />submitted by Boot Jack Ranch's consultant Scott Johnson of Summit Engineering. The permit area for <br />disturbance also extends into the San Juan River. It was apparent that excavators go into the river to take <br />material out. In the application, maps portrayed that the mine permit boundary is just the stockpile area. <br />These issues will be addressed in an adequacy letter. <br />The financial warranty estimate will be calculated once adequacy issues are addressed in the application. <br />Responses to this inspection report should be directed to Stephanie Mitchell at the Division of Reclamation, <br />Mining and Safety, Grand Junction Field Office, 101 South 3rd Street, Room 301, Grand Junction, Colorado <br />81501, phone number (303)866-3567 ext 8180. <br />Page 2 of 5 <br />
