Box 628 <br />Nucla, CO 81424 <br />Regarding: Retaining Two Topsoil Stockpiles and Associated Footprints as Permanent Features <br />Dear Mr. Ferris, <br />Per our discussion in regards to retaining two topsoil stockpiles and the stockpile footprints as <br />permanent features in accordance with Rule 1.04(71), this letter is to serve as formal notification that as <br />the surface landowner, Slash M LLC (Morgans) would like the topsoil stockpiles and their associated <br />footprints to remain as permanent features on our property. <br />Rule 1.04(71) states, "...All of the land uses defined below may include land used for support facilities <br />which are adjacent to, or are an integral part of the land..." Retention of the topsoil stockpiles and <br />footprints of the stockpiles on our property will be utilized as a support facility, directly adjacent to <br />reclamation areas, so that our stockpiled topsoil can be accessed and utilized when needed.
