The Board imposes against Robinson Sons, Inc. the following CORRECTIVE <br />ACTIONS: <br />(1) By July 24, 2019, advance the reclamation of affected lands as necessary <br />to ensure the sufficiency of the existing $52,815.00 financial warranty; OR <br />(2) by July 24, 2019, submit to the Division the additional financial warranty <br />in the amount of $120,915.00. <br />The Board finds that, in accordance with section 34-32.5-118(1)(b), C.R.S., the <br />financial warranty for permit number M-2008-076, in the amount of $52,815.00, is <br />subject to forfeiture. In accordance with section 34-32.5-118(2), C.R.S., the Board <br />directs the Division to notify Operator and all financial warrantors, if any, that the <br />financial warranty for permit number M-2008-076 may be ordered forfeited at a <br />Board hearing to be held at least thirty days after receipt of such notice. <br />The Board imposes a CIVIL PENALTY of $64,000.00 pursuant to section 34- <br />32.5-124(7), C.R.S. All of the total assessed civil penalty is suspended if the <br />Operator complies with the corrective action in the time specified. If the Operator <br />does not timely comply with the corrective actions set forth in this Order, then the <br />suspended penalties, $64,000.00, shall be due and payable in: full within thirty (30) <br />days of the deadline for completion of the corrective action. Any party adversely affected <br />or aggrieved by agency action may commence an action for judicial review by filing <br />a complaint with the district court within thirty-five (35) days after the effective <br />date of this order, pursuant to section 24-4-106, C.R.S. (2018) and the Colorado <br />Rules of Civil Procedure.
