Exhibit S — Permanent Man-Made Structures <br /> Buried utilities,overhead power lines and individually owned water wells are located within the 200-foot <br /> buffer of the proposed boundary. Arnolds Custom Seeding has opted for option (a) under section 6.4.19 <br /> of the Code of Colorado Regulations that states: <br /> The applicant may provide a notarized agreement between the applicant and the person(s) having an <br /> interest in the structure, that the applicant is to provide compensation for any damage to the structure. <br /> Existing manmade structures within 200 ft of the mining area include: <br /> • Water wells owned by: <br /> o Mark Arnusch; <br /> o Stanley Gingerich; <br /> o Elaine and Frederick Hepner; <br /> o Keene Storage;and <br /> o Prospect Valley Farms <br /> • Buildings owned by: <br /> o Elaine and Frederick Hepner; <br /> o Stanley Gingerich; <br /> o Sarah Petty; and <br /> o Turnpike LLC. <br /> • An overhead powerline owned by Morgan County REA; <br /> • A high pressure gas line owned by Xcel Energy; <br /> • A fiber optic owned by Century Link;and <br /> • An underground waterline owned by Noble Midstream. <br /> Structure agreements have been drafted and mailed to all interested parties except for Century Link and <br /> Prospect Valley Farms. A point of contact was identified and numerous attempts to contact have been <br /> left unanswered.They are both assumed to be non responsive and a physical address for mailing cannot <br /> be obtained. <br /> Return receipts for all certified mailings have been received except for landowner Sarah Petty,Morgan <br /> County REA and Noble Midstream. Copies of correspondence and certified mail return receipts are <br /> attached to this exhibit. <br />
