Dear Mr. Hays In response to your letter dated May 3, 2019 regarding an Incomplete Submittal of the 110 to 112 Construction Materials Reclamation Permit Conversion Application Package (CN-01), File No. M-2016-022, and to the Pre-Operation Inspection Report dated April 23, 2019, Duraroot, LLC(Duraroot) has prepared the following submittals : • Revised Reclamation Permit Application to reflect the exact company name as registered with the Colorado Secretary of State Office as Arnolds Custom Seeding, LLC; • Revised organization type as Limited Liability Company(LLC) in Section 1.1 of the application form; • Revised location information in Section 9 of the application form to include the quarter/quarter section for which the center of the mining operation is located; • Documentation providing Tyrun Huwa the authority to sign on behalf of Arnolds Custom Seeding, LLC; • Documentation providing Duraroot, LLC the authority to act on behalf of Arnolds ustom Seeding, LLC; i • Revised Exhibit C to indicate approximately 160 acre permit boundary and the approv d 9.9 acre permit boundary; • Revised Exhibit F to indicate approximately 160 acre permit boundary and the approved 9. acre permit boundary; • Revised Exhibit R providing receipt indicating the date on which the revised conversion applic tion documents were filed with the Weld County Clerk and Recorder;and • As per the Pre-Inspection Report, Exhibit S has been revised to include a structure a'greement wi Noble Midstream for the presence of an underground waterline located in the northw t corner the permit boundary and to Morgan County REA for the overhead power lines along the astern an southern permit boundaries. The structure identified in the Pre-Inspection Report as a wa r well i actually a waterline riser that is no longer in use. These additional features have been identi 'ed in the revised Figure C-3 and additional structure agreements are provided in Exhibit S. Additional revisions include: • Exhibit G—Water Information:An Approved Jurisdictional Determination has been received from he US Army Corp of Engineers(USACOE).
