<br /> <br /> <br /> <br /> 6 <br />based on IBLA decision 94-366. <br /> <br />Coal processing waste generated at the wash plant facility is trucked approximately 3.6 miles to <br />the refuse disposal area located east of the rail loadout in the northeast portion of the permit area. <br />The refuse disposal area includes eleven subareas of refuse deposition. The first subarea (RP-1) <br />was reclaimed in late 1990, implementing a revegetation study that involved variations from the <br />required four feet of cover. Combined Refuse Area RP-2/3/4, and the adjacent Refuse Area RP- <br />5A are currently active, and the remaining subareas have yet to be developed. Non-coal solid <br />wastes are hauled to an off-permit landfill by a contract trash service or are disposed of at the <br />Halandras landfill in the northwest portion of the permit area. The first six pits of that landfill <br />have been reclaimed and pits 7 and 8 are active. <br /> <br />Refuse and landfill areas and degas well pads are reclaimed contemporaneously. Certain facility <br />areas used during initial mine construction have been reclaimed and a few additional facilities <br />will be reclaimed during the life of the operation if they no longer have operational utility. Most <br />surface area disturbance will not be reclaimed until all mining has ceased. Mine-related surface <br />disturbances to be reclaimed at that time include the D/B-Portal area facilities, water storage <br />area, overland conveyors, slot storage area, loadout area, and the alluvial well field/lagoon area <br />at Scullion Gulch. All permitted access roads and the refuse haul road will be reclaimed. All <br />light use roads will be reclaimed, with the exception of pre-existing roads used to access <br />exploration or de-gas drill sites, which BLM designates to be retained for post-mine use. With <br />the exception of the D/B-Portal area sediment pond, all sediment ponds controlling runoff from <br />various surface facilities will be retained until vegetation on reclaimed areas is sufficient to <br />control erosion. The D-Portal pond will be removed at the time of structural demolition and <br />regrading of the facilities area. Alternative sediment control measures will be employed for the <br />reclaimed facility area. <br /> <br />Reclamation of all surface disturbances will involve the sealing of all portals, the removal of all <br />surface structures, backfilling to approximate original contour, reestablishment of disturbed <br />drainage patterns, replacement of topsoil on regraded areas and the seeding and mulching of <br />those topsoiled areas. Seeded areas may be fertilized based on evaluation of specific fertility <br />tests of topsoiled areas. <br /> <br />Status of Previous Stipulations <br /> <br />Stipulation No. 1: <br /> <br />1A PRIOR TO ISSUANCE OF A PERMIT TO CONDUCT MINING OPERATIONS, THE <br />APPLICANT MUST: SUBMIT A PERFORMANCE BOND PAYABLE TO THE STATE <br />AND THE US GOVERNMENT IN AN AMOUNT CONSISTENT WITH THE <br />REQUIREMENTS OF (B) BELOW AND THE RECLAMATION COST ESTIMATES <br />CONTAINED IN THE APPLICATION. <br /> <br />Status: This stipulation was satisfied and terminated on July 27, 1981. <br /> <br />Stipulation No. 2:
