28 and its access road are shown on Map 90 of the PAP. D. Surface and Ground Water Monitoring 1. The applicant will conduct monitoring of ground water in a manner approved by the Division. The ground water monitoring plan can be found in Section II.C.3.h, Vol. I of the permit application (4.05.12(1)). 2. The applicant will conduct monitoring of surface water in a manner approved by the Division. The monitoring plan was submitted under 2.05.6(3)(3)(b)(iv) and can be found in Section II.C.2.e of permit application, Vol. I (4.05.13(2)). Currently, surface water monitoring is currently limited to monitoring required under the CDPS discharge permit, as necessary to demonstrate compliance with water quality standards and effluent limitations pursuant to 4.05.2. Additional surface water monitoring which had previously been required was terminated in 1997, pursuant to TR-47. The Division has reviewed the surface and ground water monitoring plans as part of the RN-07 renewal process. These monitoring plans are adequate to monitor for development of impacts, if any should develop. The 2008 Annual Hydrology Report stipulated that the groundwater point of compliance for 2007-2008 was monitoring well 29-4M. In subsequent years, the groundwater point of compliance became monitoring well 22-3M. E. Stream Buffer Zones 1. The Division approved underground mining activities within 100 feet of a perennial stream with a biological community. This decision was based on a finding that the original stream channel will not be affected, water quality and quantity will not be adversely affected as a result of the disturbance, and appropriate riparian vegetation will be reestablished upon final reclamation. The buffer zone variance is granted for the raw water lagoon and dike along the White River, at the mouth of Scullion Gulch. A riparian revegetation plan is provided in Section V.1.4.h of the permit application (4.05.18(1)). F. Probable Hydrologic Consequences The probable hydrologic consequences of mining within the Deserado Permit Area are addressed within Section II.C.5 of the permit application. The permittee’s statement of hydrologic effects has been reviewed by the Division for compliance with Rule 4.05.1 and 2.05.6(3). 1.
