4.5 Postmining Land Use <br /> All surface lands disturbed by mining and development activities (except previous mining) will <br /> be restored to a condition that is capable of supporting and improving the land use that has <br /> existed before the mining or to the newly designated land use. The land use classification <br /> under Garfield County Zoning regulations is shown on Figure 3.1-2 and is currently designated <br /> Agriculture/PUD. This land use includes areas for grazing lands,with wildlife habitat as <br /> secondary use, developed water resources, areas of steep mountain shrub considered <br /> undeveloped land, some residential land use and areas for cropped hay. <br /> The landowner of the disturbed area has determined the immediate best use of the reclaimed <br /> land will be for. It is,therefore, the intention of the final reclamation plan to restore and <br /> improve,where possible and practical, the level of usefulness of the lands as a result of the <br /> reclamation process. <br /> A signed document of the landowner, NCIG Financial, Inc., indicates the Company's approval of <br /> this alternative land use. See page 4-70. <br /> The new landowner may farm organic produce in 2019. This activity should not require a <br /> change in the postmining land use because the faming activity would not be conducted within <br /> the disturbed area. <br /> The postmining land use is compatible with adjacent land use. This land use is compatible with <br /> Garfield County Zoning regulation of Agriculture/PUD. <br /> The postming land use will not present actual or probable hazard to public health or safety nor <br /> will it pose actual or probable threat of water flow diminution or pollution contrary to State or <br /> Federal laws, Rules or Regulations.
