The assessment included a desktop review and a field investigation. Species considered included <br /> those listed by the U.S. Fish and Wildlife Service (USFWS) as threatened, endangered, proposed, or <br /> candidate; State of Colorado as threatened, endangered, or species of special concern; and migratory <br /> birds. Species activity data from Colorado Parks and Wildlife (CPW) was reviewed as part of the <br /> assessment. Results of the desktop and field evaluations are summarized below. <br /> 3.1 Regulations <br /> 3.1.1 Federal <br /> The Endangered Species Act (ESA) protects threatened and endangered species and their habitats and <br /> requires consultation with and concurrence by the USFWS for projects that have the potential to affect <br /> federally listed species.The ESA makes it unlawful to take a listed animal without a permit.Take is defined <br /> as, "...to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect or attempt to engage in <br /> any such conduct." <br /> The Migratory Bird Treaty Act (META) makes it illegal to take, possess, import, export, transport, sell, <br /> purchase, or offer for sale, purchase, any migratory bird, or the parts, nests, or eggs of such a bird except <br /> under the terms of a valid federal permit. Migratory bird species protected by the Act are listed in 50 CFR <br /> 10.13. The Bald and Golden Eagle Protection Act (BGEPA) provides additional protections for bald or <br /> golden eagles. <br /> 3.1.2 State <br /> Colorado Parks and Wildlife (CPW) maintains a list of threatened and endangered species in the state of <br /> Colorado.
