Ecological Resource Consultants, Inc. <br /> 5672 Juhls Drive-Boulder,CO—80301-(303)679-4820 <br /> May 8,2019 <br /> J-2 Contracting Company <br /> 105 Coronado Court, Unit A-101 <br /> Fort Collins CO 80525 <br /> RE:Aquatic Resource Status <br /> The enclosed Aquatic Resource Delineation Report (ERC 5-8-19) has identified several aquatic resources <br /> (Aquatic Resources A, B, C, D, E and F) within the proposed mining phase limit of the DPG Site. The <br /> findings of ERC 5-8-19 have determined that these aquatic resources are likely non-jurisdictional and not <br /> subject of Section 404 Clean Water Act. A request for an Approved Jurisdictional Determination is <br /> pending from the US Army Corps of Engineers Denver Regulatory Office (USACE) in order to verify <br /> jurisdictional status of all aquatic resources on the DPG Site. <br /> Upon verification from the USACE, it is anticipated that the areas identified herein as Aquatic Resources <br /> A, B, C, D, E and F will not be considered jurisdictional and will not require any further coordination <br /> and/or authorization from the USACE for disturbance associated with the project. All other aquatic <br /> resources identified herein (Aquatic Resource G, H, I, J) are likely considered jurisdictional subject of <br /> Section 404 of the Clean Water Act. <br /> If you have any questions or require clarification, please feel free to contact me directly. <br /> ;A <br /> David pca <br /> David J.
