ARCOSA 17 May 2019 Transmitted via electronic mail Mr.Eric Scott Division of Reclamation Mining Safety Department of Natural Resources 1313 Sherman Street, Suite 215 Denver,CO Re: TRNLWB LLC,Western Aggregates(Arcosa Materials,Inc.),Permit M-1988-108 Proof of Public Notice Dear Mr. Scott: In accordance with Sections 1.6.2(g)and 1.6.5(2)of the Mineral Rules and Regulations, enclosed please find proof of publication and proof of all required notices for Arcosa's permit number M-1988-108 amendment application. With this letter we are providing the Division of Reclamation and Mining Safety(DRMS)a copy of the certified mail receipts for notices that were mailed to owners of record of surface and mineral rights and owners of record of land surface within 200 feet of the affected lands boundary.In addition,we are providing a copy of the affidavit provided by the Golden Transcript documenting that the public notice was published for four consecutive weeks in the local newspaper. The newspaper notices were published on April 18,April 25,May 2,and May 9,2019.These notices listed the public comment period as ending 20 days after the last notices,which is May 29,2019. However, due to an inadvertent oversight,the notices to owners of record of surface and mineral rights and owners of record within 200 feet of the permit boundary required by Section 1.6.2(e)(i)and(ii)were not mailed after the first notice was published in the newspaper. Rather they were mailed shortly after the last notice was published effectively condensing the public comment period for these owners. To remedy this,new notices were sent to affected land owners with an extended public comment date of June 4,2019 to provide those land owners at least 20 days to provide comments.Notices mailed to landholders include: • Colorado Department of Transportation • US Department of Energy—National Renewable Energy Lab • The Hogan Family • American Contract Miners • Old Tyme Saw Mill;John Sainsbury • Mountain Plains Industrial Center,LLC. • JoAnn T Sharp Revocable Trust;Bill Hogan Living Trust • City of Boulder Included in the notice is a description of the permit amendment that has been filed,the date of commencement and proposed date of completion for the amendment.The notice also clarifies the jurisdiction of DRMS with respect to certain public comments. A copy of the public notice published in the newspaper,a copy of the notice mailed to owners,a copy of the affidavit from the Golden Transcript,and certified mail receipts are attached. 1
