Mr. Ragsdale <br /> May 16, 2019 <br /> Page 7 of 9 <br /> (4) You must indicate the projected amount from each of the sources of water to supply the project water <br /> requirements for the mining operation and reclamation. <br /> (5)You must affirmatively state that the Operator/Applicant has acquired(or has applied for) a National Pollutant <br /> Discharge Elimination System(NPDES)permit from the Water Quality Control Division at the Colorado <br /> Department of Health, if necessary. <br /> The application provided describes in general terms the surrounding geology, water bodies, aquifers, ditches and <br /> diversions. Please provide a regional/local map and geologic cross sections to illustrate the information <br /> provided and help clarify how the operation will not impact the surrounding surface and groundwater. <br /> The permit states that water collected in the pit will collect in a sump and be discharged in accordance with <br /> discharge permit requirements. Review of recent aerial photography shows approximately 14 acres of water <br /> standing in the quarry pit bottom (depth unknown). The application also indicates that this water is composed of <br /> a combination of surface runoff and groundwater seepage (seeps clearly visible in air photos along south side of <br /> pit). Please demonstrate that the presence of and consumptive use of 30,000 gallons a day from these water <br /> bodies is in compliance with the applicable SEO regulations. <br /> Assuming that the post reclamation pond as proposed complies with SEO requirements, what is the basis for the <br /> assumption that the post reclamation pond will stabilize at the size shown on the reclamation plan map, when it <br /> currently covers approximately 14 acres and is reportedly pumped at a rate of 30,000 gallons a day? <br /> Approximately 50-70 tons per day of process waste is disposed of on-site by end dumping from the top of the pit <br /> within the unlined quarry excavation - which at this time contains a significant amount of exposed water. The <br /> operator will need to provide sufficient information to demonstrate that they are in compliance with Colorado <br /> Department of Public Health and Environment, Water Quality Control Commission 5 CC R. 1002-41, Regulation <br /> No. 41 - The Basic Standards for Groundwater(WQCC Rule 41). This will likely require (at least)an in depth <br /> characterization of local geology and quarry pit,process waste and waste placement(existing and future), <br /> background/up-gradient groundwater conditions,pit water, current surrounding/downgradient groundwater <br /> conditions, and a comparison of existing groundwater to the Table Value Standards contained in Rule 41. The <br /> operator should also include a monitoring plan with proposed points of compliance to monitor downgradient <br /> groundwater for possible impacts due to the disposal of process waste in the pit. <br /> The predictions for long term quality of water in the post reclamation pond within the pit should also be <br /> discussed, especially if this water will be available to livestock and wildlife. <br /> Due to the on-site waste disposal at this site, and apparent lack of historical data, this is potentially a complex <br /> issue to address. Therefore, DBMS would be willing to meet with the operator and/or their consultant to discuss <br /> the requirements of this exhibit. <br /> EXHIBIT L -Reclamation Costs (Rule 6.4.12): All information necessary to calculate the costs of reclamation <br /> must be submitted and broken down into the various major phases of reclamation. You must provide sufficient <br /> information to calculate the cost of reclamation that would be incurred by the state. <br /> Please resubmit this exhibit-considerably more information and details will be required for this exhibit to meet <br /> the requirements of Exhibit L as listed above.
