Schedule is attached is subject to the following exceptions,
reservations, liens and encumbrances.
General
Mineral exceptions and reservations and any leases or
other instruments relating to minerals.
The effect of the inclusion of any of the property in
any of the following special districts: Routt County Soil
Conservation District, Solandt Memorial Hospital District, West
Routt Planning District, the Hayden Cemetery District, Upper Yampa
Water Conservancy District, and West Routt Fire Protection
District.
The effect of rules, regulations, ordinances and
resolutions of Routt County and agencies thereof of general
application.
The lien for taxes and assessment not presently due and
payable.
• Reservations and exceptions in patents from the United
States or the State of Colorado.
County Road Nos. 33 and 53.
Farm and ranch leases terminating or terminable on or
before December 31, 1992.
Easements or rights-of-way for any of the following
ditches and reservoirs: Walker Ditch, Dry Creek Ditch, Bates
Ditch, Magden Ditch, Shelton Ditch and enlargement and extension
thereof, Sage Creek Reservoir, Sage Creek Reservoir Outlet Ditch,
and Greasewood Flats Reservoir.
Easements or rights held by Peabody Coal Company or
Seneca Coals, Ltd. including Option for Right-of-Way Easement dated
April 10, 1974 from Robert V. Barnes and Mary Jo Barnes, Option for
Right-of-Way Easement dated April 3, 1975 from Howard Erwin and
Ethyl Erwin and Agreement dated July 6, 1978 among Peabody, Seneca
and H-G recorded in book 475 at page 520.
