Under
43 CFR 3452.1-3, the BLM can approve a relinquishment if it determines (1) the relinquishment
will not impair the public interest, (2) any accrued rentals and royalties have been paid, and (3)
the lessee has met all the obligations under the regulations and terms of the lease.
On April 8, 2019, BLM's Little Snake Field Office (LSFO) determined that accepting the
relinquishment will not impair the public interest. The LSFO also found that TC met all of its
obligations under the terms of the lease and applicable regulations and are in compliance with
the completion of operations and permanent abandonment procedures. The Office of Natural
Resources Revenue reviewed the lease status and indicated there are no accrued rentals and
royalties due. Therefore, pursuant to regulations found at 43 CFR 3452, the BLM accepts this
relinquishment, effective April 29, 2019, the date of filing.
The liability period under Federal Coal Lease Bond COB000255, surety bond number 1033792,
with Twentymile Coal, LLC, as the principal and Lexon Insurance Company as surety, may be
terminated as of the date of this decision.
The case file is closed effective the date of this decision and our records noted accordingly.
Please contact Becky Backlund, Land Law Examiner, at (303) 239-3987 with any questions.
Sincerely,
Jamie E. Connell 146
cceI?tate Director
