PART 11 <br /> Permit No.: COR400000 <br /> d. Daily maximum violations for any of the pollutants limited by Part I of this permit. <br /> This includes any toxic pollutant or hazardous substance or any pollutant specifically <br /> identified as the method to control any toxic pollutant or hazardous substance. <br /> e. The division may waive the written report required under subparagraph 6 of this <br /> section if the oral report has been received within 24 hours. <br /> 7. Other non-compliance <br /> A permittee must report all instances of noncompliance at the time monitoring reports <br /> are due. If no monitoring reports are required, these reports are due at least annually <br /> in accordance with Regulation 61.8(4)(p). The annual report must contain all instances <br /> of non-compliance required under either subparagraph 5 or subparagraph 6 of this <br /> subsection. <br /> 8. Other information <br /> Where a permittee becomes aware that it failed to submit any relevant facts in a permit <br /> application, or submitted incorrect information in a permit application, or in any report <br /> to the Permitting Authority, it has a duty to promptly submit such facts or information. <br /> M. BYPASS <br /> 1. Bypass not exceeding limitations <br /> The permittees may allow any bypass to occur which does not cause effluent limitations <br /> to be exceeded, but only if it also is for essential maintenance to assure efficient <br /> operation. These bypasses are not subject to the provisions of Part II.M.2 of this permit. <br /> See 40 CFR 122.41(m)(2). <br /> 2. Notice of bypass <br /> a. Anticipated bypass. If the permittee knows in advance of the need for a bypass, the <br /> permittee must submit prior notice, if possible at least ten days before the date of <br /> the bypass. ee 40 CFR S122.41(m)(3)(i) and/or Regulation 61.9(5)(c). <br /> b. Unanticipated bypass. The permittee must submit notice of an unanticipated bypass <br /> in accordance with Part 111.6. See 40 CFR S122.41(m)(3)(ii) . <br /> 3. Prohibition of Bypass <br /> Bypasses are prohibited and the division may take enforcement action against the <br /> permittee for bypass, unless: <br /> i. the bypass is unavoidable to prevent loss of life, personal injury, or severe <br /> property damage; <br /> Page 27 of 33 <br />
